Terms of Use

These "Terms of Use" set forth the terms and conditions that apply to your use of the Team Dynamite Website. By using the Web Site (other than to read this page for the first time), you agree to comply with all of the Terms of Use set forth herein. You are entering into a Membership Agreement.  The right to use the Web Site is personal to you and is not transferable to any other person or entity. 

Copyrights and Trademarks
A. All materials contained on the Web Site are Copyright and are the property of their respective owners.  All rights reserved.

B. No person is authorized to use, copy or distribute any portion the Web Site including related graphics.

C. Team Dynamite, Putting the Home Back in Home-Based Business, Excellence Performance Coaching, Video Latte, and other trademarks and/or service marks (including logos and designs) found on the Web Site are trademarks/service marks that identify the TM and the goods and/or services provided by the owner(s) of their respective trademarks. Such marks may not be used under any circumstances without the prior written authorization of the Board of Directors of Team Dynamite, Inc. and their owners.

Links to Third-Party Web Site
Team Dynamite may provide hyperlinks to third-party web sites as a convenience to users of the Web Site.  Team Dynamite does not control third-party web sites and is not responsible for the contents of any linked-to, third-party web sites or any hyperlink in a linked-to web site. Team Dynamite does not endorse, recommend or approve any third-party web site hyperlinked from the Web Site. Team Dynamite will have no liability to any entity for the content or use of the content available through such hyperlink.

No Representations or Warranties; Limitations on Liability
The information and materials on the Web Site could include technical inaccuracies or typographical errors. Changes are periodically made to the information contained herein. TEAM DYNAMITE MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO ANY INFORMATION, MATERIALS OR GRAPHICS ON THE WEB SITE, ALL OF WHICH IS PROVIDED ON A STRICTLY "AS IS" BASIS, WITHOUT WARRANTY OF ANY KIND AND HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES WITH REGARD TO ANY INFORMATION, MATERIALS OR GRAPHICS ON THE WEB SITE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES SHALL THE SITE OWNER OR PUBLISHER BE LIABLE UNDER ANY THEORY OF RECOVERY, AT LAW OR IN EQUITY, FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, SPECIAL, DIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO LOSS OF USE OR LOST PROFITS), ARISING OUT OF OR IN ANY MANNER CONNECTED WITH THE USE OF INFORMATION OR SERVICES, OR THE FAILURE TO PROVIDE INFORMATION OR SERVICES, FROM THE WEB SITE.

Indemnity
You agree to indemnify, defend and hold Team Dynamite, Inc. and its affiliates, and their respective directors, officers, employees, shareholders, partners and agents harmless from and against any and all claims, liability, losses, costs and expenses (including lawyers’ fees on a solicitor and client basis) incurred in connection with: (i) any use or alleged use of the Site under your Member Name by any person, whether or not authorized by you; (ii) or resulting from any communication made or Content uploaded under your Member Name; or (iii) any breach by you of this Membership Agreement.

Cancellation Notice for Orders of $25.00 or more. 
You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the transaction, as mandated by the Federal Trade Commission.  You may cancel this transaction, without any penalty or obligation, within three business days from the date of purchase.  To cancel this transaction, you must deliver a signed and dated copy of your notice of cancellation to:  Team Dynamite, Inc., 4904 Commonwealth Rd., Palmetto, FL  34221 no later than midnight of the third business day after the transaction.  Your payment will then be returned within 10 business days following receipt of your written, signed, and dated notice of cancellation, and any security interest arising out of the transaction will be cancelled.  There will be no refund issued for the Leadership Training Weekend events, regardless of the date of purchase, once the access and handouts have been sent to you, or once the event has been completed.  There will be no refund issued for any one time training events once the event has taken place.  The month-to-month agreement can be cancelled by you at any time, or you can contact us at usanatony@ aol.com at least 10 business days prior to the end of your current billing cycle.  Whether you cancel it, or we cancel it for you, you’ll have access for the remaining current billing cycle or month of service, and after that cycle, you will no longer auto-renew and your month-to-month membership will be cancelled.  However, you can renew again at any time.

Confidential Information
You acknowledge that the confidential information (defined below) which you obtain through the use of the website constitutes valuable, confidential, proprietary information of Team Dynamite, Inc. and its affiliates, and you agree that during the term of this membership agreement and thereafter you shall not, without the express written consent of Team Dynamite, Inc. use or disclose to any other person any such confidential information, except as specifically authorized under this membership agreement or as required by applicable law.

For the purposes of this Membership Agreement, “Confidential Information” means any and all data, photos, videos, training, information, documents, software or materials relating to the business and management of Team Dynamite, Inc., its members, affiliates, licensors or licensees, that is designated as confidential or ought reasonably to be considered confidential, including but not limited to: their business model and operations, processes, products, designs, pricing, promotions, business plans, development, training materials, clients, methodologies, etc. site content belonging to others and other intellectual property.

Changes to These Terms of Use
Team Dynamite reserves the right to change these Terms of Use at any time by posting new Terms of Use at this location. You can send e-mail to usanatony@ aol.com with any questions relating to these Terms of Use at Team Dynamite via teamdynamite.net and all related websites.
